Terms of service

These terms apply to vagents.in and the VAgents platform, provided by VAgents Labs ("VAgents", "we"). A signed agreement with a customer takes precedence over these terms where the two differ.

1. The service

VAgents lets businesses build AI agents that make and take phone calls and chat with their customers. We may improve or change features over time; we will tell customers in advance of any change that reduces what they rely on.

2. Accounts

Customers are responsible for the people they invite to their workspace, for keeping sign-in details and access tokens safe, and for everything done under their account.

3. Using it lawfully

Customers must:

• have a lawful basis, and any consent needed, to call or message the people on their lists;
• follow TRAI's rules on commercial communication, including calling hours and Do Not Disturb preferences;
• tell callers where the law requires it that they are speaking with an automated agent and that calls are recorded;
• not use VAgents for spam, fraud, harassment, or anything unlawful.

We may suspend an agent that breaks these rules.

4. Customer data

Customers own the data they put into VAgents and their agents' recordings and transcripts. We use it only to provide the service, as set out in our privacy policy.

5. Fees

Fees are based on usage under the customer's plan or quote. Invoices are payable within the period stated on them; taxes are extra.

6. AI output

AI agents can make mistakes. Customers set what their agents may say and do, and should review important outcomes. We are not liable for decisions made solely on an agent's output.

7. Liability

To the extent the law allows, our total liability in any twelve months is limited to the fees the customer paid us in that period, and we are not liable for indirect or consequential loss. [confirm with lawyer]

8. Ending the service

Either side may end the service as set out in the customer's agreement. On request, we return or delete the customer's data.

9. Law

These terms are governed by the laws of India; the courts of Rewa, Madhya Pradesh have jurisdiction.
